1. SCOPE OF THIS POLICY
1.1 This Privacy Policy (this “Policy”) applies to any person who browses or otherwise interacts with the informational website of AirStone (the “Site”), including the sections relating to: (i) Residential; (ii) Homes; and (iii) Development.
1.2 This Policy governs both the information collected through general browsing of the Site (cookies, pixels, analytics, and similar technologies) and the information a user chooses to voluntarily provide through the general contact section (“Inquiries”), which directs the user to send an email directly to the mailbox designated by AirStone, as further described in Section 5-Bis of this Policy. As of this update, the Site does not include web forms that capture and store personal data directly on the Site (for example, forms with fields for name, phone number, or specific interest); the only general contact channel is the “Inquiries” section described above.
1.3 If a user chooses to access the specific AirStone Homes section and provides personal data through the forms enabled for that flow, the collection and processing of such data will be governed by the AirStone Homes-specific Privacy Policy, which will prevail over this Policy with respect to the information provided there.
2. INFORMATIONAL NATURE OF CONTENT REGARDING RESIDENTIAL AND DEVELOPMENT
2.1 The information published on the Site regarding Residential and Development, is provided for informational purposes only. and is intended to showcase AirStone’s track record and experience in the real estate sector
2.2 Such information does not constitute an offer, invitation, solicitation, or recommendation to invest, and is not directed at soliciting investors from the general public. Participation in the referenced investment fund is limited and is not available to the general public visiting the Site.
2.3 The Site does not collect, through the sections described in this Section, information intended to assess any user’s eligibility as an “accredited investor” or any similar regulatory category.
3. INFORMATION COLLECTED AUTOMATICALLY
3.1 When a user browses the Site, certain information may be collected automatically through technology and digital analytics tools, including: IP address, device identifiers, approximate geolocation information, browser type, operating system, pages visited, browsing time, interaction with advertisements, browsing behavior, clicks, conversions, and other information related to the use of the Site.
4. COOKIES, PIXELS, AND SIMILAR TECHNOLOGIES
4.1 The Site uses cookies, pixels, SDKs, tags, web beacons, and similar technologies for: (i) analytics and audience measurement purposes; (ii) content personalization; (iii) optimizing the Site’s performance; and (iv) advertising purposes, including remarketing and audience creation through platforms such as Meta (Facebook and Instagram), Google, and other third-party advertising platforms.
4.2 These technologies enable, among other things, AirStone advertisements to be shown to a user on other platforms or websites after the user has visited the Site, as well as the creation of lookalike audiences for advertising purposes, based on the browsing behavior of Site users.
4.3 Certain third parties (including Meta and Google) may collect information directly from a user’s browser or device, in accordance with their own privacy policies. AirStone does not control the independent practices of such third parties and recommends that users review their respective privacy policies.
4.4 Users may configure their browser to reject certain cookies or limit certain tracking mechanisms; however, some features of the Site may be affected as a result.
5. USE OF INFORMATION COLLECTED
5.1 The information collected pursuant to Sections 3 and 4 above is used to: (i) measure and analyze the Site’s performance and usage; (ii) optimize AirStone’s advertising and digital marketing campaigns; (iii) generate internal metrics; and (iv) improve the user’s browsing experience.
5.2 The information described in Sections 3 and 4 above, collected through general browsing of the Site, is not used to directly contact users nor for commercial lead-generation purposes. This is without prejudice to information a user chooses to voluntarily provide through the “Inquiries” section described in Section 5-Bis, or information provided upon accessing the AirStone Homes-specific flow described in Section 1.3.
5-BIS. GENERAL CONTACT SECTION (“INQUIRIES”)
5-Bis.1 The Site includes a general contact section (“Inquiries”) that directs the user to send an email to inquiries@airstonegroup.com, using the user’s own email client. The Site does not host or directly store the data submitted through this section; such data is transmitted directly to AirStone through the email the user chooses to send.
5-Bis.2 If a user sends an email through this section, the information voluntarily included (for example, the user’s name, email address, and the content of the inquiry) will be used by AirStone solely to respond to the inquiry and for internal follow-up and record-keeping purposes.
5-Bis.3 AirStone may share the content of such inquiries internally among the different business units of Grupo Coen (including AirStone and other related companies), as necessary to properly address the user’s inquiry, depending on its nature.
5-Bis.4 If, as a result of such inquiry, the user is referred to AirStone Home’s specific operational flow, any subsequent processing of the user’s information will be governed by the privacy notice specific to that flow, as referenced in Section 1.3.
6. RIGHT TO OPT OUT OF THE SALE OR SHARING OF INFORMATION (“DO NOT SELL OR SHARE”)
6.1 Depending on the jurisdiction from which a user accesses the Site, the use of cookies and pixels for remarketing and audience-creation purposes described in Section 4 may be considered, under certain U.S. data protection and consumer privacy laws (including, if applicable, the California Consumer Privacy Act and its amendments), a “sale” or “sharing” of personal information for advertising purposes.
6.2 As a matter of transparency, AirStone makes available to users the following mechanism to request that their information not be used for such advertising purposes, email: data.privacy@airstonegroup.com. Exercising this right does not affect general browsing of the Site, although it may limit the personalization of advertising shown to the user on other platforms.
7. SHARING OF INFORMATION WITH THIRD PARTIES
7.1 Information collected automatically under this Policy may be shared with technology providers, digital advertising platforms (Meta, Google, and similar), analytics providers, and Site hosting providers, solely for the purposes described in this Policy.
7.2 AirStone does not sell personal information to third parties as an independent commercial activity.
8. INTERNATIONAL DATA TRANSFERS
8.1 Due to the international nature of the technology tools and advertising platforms used, information collected under this Policy may be stored, transferred, or processed outside of Guatemala, including in the United States of America or other jurisdictions where AirStone’s technology providers or advertising platforms operate.
9. INFORMATION SECURITY
9.1 AirStone implements reasonable administrative, technical, and organizational measures aimed at protecting the information collected against loss, unauthorized access, alteration, or improper disclosure. However, no transmission or storage system can guarantee absolute security.
10. THIRD-PARTY LINKS
10.1 The Site may contain links to third-party websites or platforms (including social media). AirStone does not control and assumes no responsibility for the privacy practices of such third parties.
11. BROWSER PRIVACY SIGNALS (“DO NOT TRACK”)
11.1 Due to the absence of uniform standards applicable to “Do Not Track” and similar signals, the Site may not automatically respond to all such signals, without prejudice to the opt-out mechanism described in Section 6.
12. CHILDREN’S PRIVACY
12.1 The Site and its content are not directed at minors, and AirStone does not knowingly collect information from minors through the tools described in this Policy.
13. DATA RETENTION
13.1 Information collected automatically will be retained for the time reasonably necessary for the purposes described in this Policy, in accordance with the standard retention periods of the analytics and advertising tools used.
14. CHANGES TO THIS POLICY
14.1 This Policy may be updated from time to time. Any changes will be posted in this same section, indicating the date of the last update. Continued use of the Site after such changes constitutes acceptance of the updated version.
15. GOVERNING LAW
15.1 This Policy shall be governed by and construed in accordance with the laws of the Republic of Guatemala, without prejudice to certain privacy provisions of other jurisdictions that may apply to users located outside of Guatemala, as described in this Policy.
